CN Plans to Strengthen Regulation of Intelligent Connected NEVs, Distinguish Assisted from Autonomous Driving

China's State Administration for Market Regulation (SAMR) and Ministry of Industry and Information Technology (MIIT) have drafted the Notice of the SAMR and the MIIT on Strengthening the Supervision and Management of Recalls, Production Consistency, and Standardized Publicity of Intelligent Connected New Energy Vehicle (NEV) Products (Draft for Public Comment). According to the draft, car makers must display safety warnings and usage instructions for combined driving assistance systems in prominent locations within vehicle apps, in-vehicle information systems, and user manuals, making it easy for consumers to read, understand, and operate. This is to prevent drivers from mistaking combined driving assistance features for autonomous driving functions. Car makers are also required to strengthen monitoring of defect information in intelligent connected NEVs, and reduce the risk of vehicle accidents caused by cyberattacks, cyber threats, and vulnerabilities. The SAMR will investigate defects related to incomplete safety warnings and instructions, cyberattacks, cyber threats, and vulnerabilities, and, when necessary, urge car makers to make improvements through recalls. When naming or marketing combined driving assistance systems or features, car makers must not imply to consumers that these are autonomous driving systems or possess functions they do not actually have, in order to prevent driver misuse.
